GENERAL STALLHOLDER INFORMATION – ALL MARKETS.

FEES & PAYMENTS:

Each Market has a variety of stall size options available. All invoices are issued a minimum of one week prior to each event and must be paid prior to trade, without exception. Payment is to be made online, via the link emailed. Cash and direct deposit payments are not accepted. Stall pricing is determined by the Market, the size of the site and the usage – refer to below for current pricing as at Jan 2026 (subject to change at any time);

STALL SITE PLACEMENT
We do not offer permanent site allocations and do not accept demands of placement. Site allocations are sent via email prior to Market day. Stallholders can not rearrange or move their site without Market Management permission. You must not request that another Stallholder moves their site or changes position, please contact Management should this issue arise. We understand that not everybody will get along with their neighbour, however we do ask that you are kind, courteous and considerate at all times in our workplace. If you wish to be moved, or have a grievance with someone, please let us know.

STALLHOLDER’S CODE OF CONDUCT
The Caloundra Markets team aims to deliver the best Market experience on the Sunshine Coast. We wish to maintain an authentic experience where friendly stallholders work alongside each other to create an unforgettable event out for residents and visitors. The Caloundra Markets management team will protect the integrity and authenticity of our events, implementing and overseeing the market’s Rules and Regulations and the accompanying Code of Conduct.
This Code of Conduct and the accompanying Rules and Regulations apply to all Caloundra Markets stallholders. The Caloundra Markets management team revises this document regularly as needed. Upon attending our events, you are inferring acknowledgement and acceptance of this Code of Conduct and
the Rules and Regulations, and your agreement to be bound by them.

Code of Conduct

  • We act with respect, courtesy and dignity at all times.
  • We interact with the public, members of the Caloundra Markets management team, fellow
    stallholders and retailers in a courteous manner.
  • We work safely and ensure the safety of others.
  • We strive to contribute to an honest, unbiased and unprejudiced market environment.
  • We refrain from any form of harassment, intimidation or unwanted physical contact of others.
  • We refrain from rude, violent, aggressive, uncooperative or belligerent behaviour toward others.
  • We refrain from verbal criticism of other stallholders or their products.
  • We reject profanity or vulgarity towards any other person, either by actions or in any language.
  • We conduct ourselves and our businesses with honesty, transparency and in the spirit of cooperation.
  • Caloundra Markets wishes to foster a culture of support and cooperation between the stallholders,
    market management and retailers. As such, stallholders are asked not to attempt to work out their
    grievances between themselves or with retailers and instead should raise any issues of complaint
    with the Caloundra Markets management through the process outlined below

Unacceptable Behaviour
Unreasonable and negative behaviour including bullying, threatening and abuse, directed at an individual or group resulting in the individual feeling unsafe, offended, humiliated, intimidated, abused or at risk is not in keeping with the ethos of the Caloundra Markets and will not be tolerated. Single incidents of unreasonable behaviour can also create a risk to health and safety. They can include any of the following;

  • Bullying of any nature
  • Verbal or physical abuse
  • Sexism and sexual harassment – unwanted or uninvited sexual behaviour
  • Racism and racist behaviour
  • Offensive, insulting or derogatory language including shouting or yelling
  • Acting in a discriminatory manner
  • Offensive, insulting or inappropriate communications (emails, social media, correspondence etc)
  • Unwarranted, unjustified or unsubstantiated criticism or comments
  • Intimidating behaviour and victimisation
  • Stealing of intellectual properties and copyright infringements
  • All reports will be treated seriously and investigated promptly, confidentially and impartially.

Breaking the Code of Conduct
A report of failure to comply with any component of the Code of Conduct will be assessed and investigated by Market Management. Consideration of complaints will be guided by the principles of fairness, impartiality and ethical behaviour. If the Code of Conduct has been broken, the Caloundra Markets management will take disciplinary action appropriate to the severity of the violation. Such actions may include verbal and written warnings, suspension from market participation and/or expulsion from the market.

Market Management Rights
The Market Manager has the right to withhold or cancel an approval to a stallholder to trade or to remove a stallholder from the Market who is in breach of the rules and code of conduct. This includes but is not limited to instances where a stallholder:
– Fails to pay their stall fee in a timely manner.
– Fails to comply with the instructions within this Stallholder Manual.
– Fails to comply with obligations relating to road rules, vehicle and traffic control.
– Fails to abide by the Market’s set up or pack up conditions.
– Fails to abide by the Market’s trading hours.
– Commits a criminal act at the market or elsewhere that is not in keeping with the integrity of the Market.
– Behaves in a manner that the Market Manager considers is inappropriate or may bring the market into disrepute.
– The Market Manager has the right to undertake any of the following actions without notice:
– Relocate a stallholder to another site within the market.
– Require the stallholder to remove from sale any good or service offered by the stallholder which is not an approved products or not deemed acceptable.
– Request that the stallholder undertake any reasonable measure which in the opinion of the Manager will improve the safety or appearance of the stall.

Reporting Grievances
If you experience or witness negative behaviour please report it immediately to the Market Manager by phone and follow up in writing at manager@caloundramarkets.com.au. All reports must clearly describe the complaint or grievance in as much detail as possible. Please refrain from using ill-chosen or derogatory language to describe fellow stallholders, market staff or retailers. Verbal complaints or discussion of potential breaches of this Code of Conduct will not be entered into on site at the market.

Disputes Procedure
If a dispute arises between stallholders/ retailers and market management, it is expected that all parties will act in good faith to resolve it as soon as possible. If a complaint is made about a stallholder, the Market Manager will provide the stallholder with written notice detailing the claim. The stallholder will be given an opportunity to respond in writing. Should the stallholder not respond and market management decide the stallholder has acted outside the
market rules/ code of conduct; market management has the right to ask the stallholder to leave the market. If the stallholder wishes to appeal the decision, they can do so by writing to the CEO of the Caloundra Chamber of Commerce whose decision will be final. Complaints about Market Management can be made in writing to the CEO of the Caloundra Chamber of Commerce.

SMOKING
All Caloundra Markets events operate in a non-smoking precinct under Queensland Law, this includes smoking and vaping. Smoking or vaping in our precincts during the hours of operation (including bump in and bump out) is prohibited.

WEATHER
The Caloundra Market events operate in a coastal location, in varying weather conditions. Unless stated otherwise by Management (which will be done via email) all events will proceed in rain and moderate wind. Safety is our priority and we will make assessments based on that, however we also have an
obligation to deliver our events to ensure our customers can rely on us to trade. Stallholders may pack up their stall due to weather conditions that are not favourable to them but are required to notify the Event Manager prior to doing so. Vehicles are not permitted in the market precinct without permission from Management. Management will not be held responsible for any loss, damage or injury whatsoever resulting from adverse weather conditions.

CREDITS/ CANCELLATION OF MARKET
In rare circumstances the market may be cancelled, stall holders will be notified via email. Stallholders who have paid for a site will be credited their site fee to be used within the next two occurrences of the cancelled market.

CANCELLATION POLICY
For the weekly markets, booking cancellations must be made by 12pm on the Wednesday prior to avoid a 50% cancellation free. Cancellations made after 5pm Wednesday will incur a 100% cancellation fee. For the monthly markets, cancellation within 7 days of the event date will incur a 100% cancellation
fee.

If a Market is cancelled prior to the day of intended trade due to adverse weather, stallholders who have already paid will receive a credit for the next event.
If a Market is cancelled on the day of trade due to adverse weather conditions, stallholders who are present and/or trading will receive a credit for the following event. Any stallholder who cancels before market management has officially cancelled or is a no show, will not receive a credit.

MARQUEE WEIGHTS COMPLIANCE
We operate coastal events and wind gusts are not an unusual occurrence. In the interest of safety, marquees are required to have a minimum of 3 weights (of at least 15kg each) attached at all times. Market umbrellas need to have a weighted base with the umbrella stand able to be securely fixed to the weight. This is a condition of your trading and not negotiable. Failure to comply will see your booking cancelled without credit.

STALL PRESENTATION
We strive to deliver one of the best experiences on the Sunshine Coast. It is important that your stall is presented in a neat, dynamic, engaging manner with all products are of the highest standard. All market stall equipment must be in good condition, for example no rust, holes or rips in the marquee, tablecloths etc. Whilst music can enhance the ambiance of your stall, please ensure the volume is kept to a minimum and the style is easy listening. Your surrounding stallholders may not have the same taste in music or may be trying to engage with their customers, please be aware of your environment and show courtesy to those around you. A high level of presentation is expected by stallholders which not only invites customers to your space, but curates a beautiful and professional looking market for the public to enjoy.

SOCIAL MEDIA POLICY
It is asked that stallholders who have business social media accounts share images promoting their stall at our market. Be sure to tag our events in any of your posts so we can re-share! Stallholders are asked to present positive messages about Caloundra Markets and their experiences with the events on social media platforms. Negative comments or airing of grievances with Management or the Chamber of Commerce on social pages owned by Caloundra Markets will result in immediate termination. All grievances can be resolved professionally by other, more appropriate means. Caloundra Markets management has the right for promotional purposes to use stallholders’ images, photos containing images of the stallholder and their product.

PUBLIC LIABILITY INSURANCE
All Stallholders are required to hold current public liability insurance, with coverage of no less than $20 million dollars. It is the stallholder’s responsibility to ensure that they are properly insured for product liability and personal indemnity and that a copy of this policy is available on site at all times. It is asked that stallholders send their current public liability insurance certificate to the market email when the one on file has expired, this is a condition of continued trade.

RUBBISH/ WASTE
It is the stallholder’s responsibility to remove their own rubbish from the Market area and to leave the site and its surrounds clean and tidy. The waste bins provided at the market are for general public use only, not for stallholder use.

SALE OR TRANSFER OF BUSINESS/STALL
Caloundra Markets does not enter into permanent or written agreements about the location, placement and regularity with any stall/business. If you wish to sell your business, please discuss with Management the impact this could have on your booking/s.

ELECTRICAL COMPLIANCE
Access to power is strictly by approval only (and not available at all events). Please seek advice from a qualified electrical contractor in regard to the amperage draw of your equipment and seek professional advice prior to entering Caloundra Markets. Double adapters are not permitted for commercial usage under any circumstance. It is essential that extension leads do not present a trip-hazard to the public. Excess cords are required to be placed safely within the stall and not accessible to the public. Exposed cords running between stalls require either covered with mats or taped with waterproof tape, please bring these with you each week. Given the high safety risk, stallholders found with non-complying or unsafe appliances or cords will have power withdrawn without notice.

Test & Tag
All electrical appliances and cords must be tested and tagged by a qualified electrical contractor in accordance with Queensland Electrical Safety Regulations 2002 and subsequent amendments. Please ensure they are up to date; we will be completing random checks as we conduct our walk of the market throughout the day.

PRODUCTS
To ensure consistency and fairness for all, you may only sell products that have been approved by Management and as listed on your initial application form.
Please seek permission from Management should you wish to add new products to your stall. It is your responsibility to ensure the products you sell conform to any safety and compliance standards pertaining to the product.
Stall holders will not have exclusivity to any product however it is the management’s intent to offer as broad a range of product as possible each and every week for everyone’s benefit. Stallholders must ensure that labelling of products and produce is in accordance with legislative guidelines and regulations.
Taste testing and sampling of any product must comply with Council and health regulations. Produce must be of the highest quality. Please ensure your product packaging is in line with the Queensland Government Single Use Plastic Legislation.

FOOD STALLS
All food stalls require a license. Please contact the Sunshine Coast Council if you require information about obtaining a Food License. Food stall applications will not be assessed without provision of a current Food License. Temporary Food Licenses need to be displayed at all times during trading hours. Given the high risks food stalls present, it is important that correct health and safety procedures are adhered to at all times and that the public are not able to access your stall at any time. It is the responsibility of all food vendors to ensure their fire and safety equipment are current and up to date. Market management will conduct checks from time to time.

EMERGENCY EVACUATION PLAN
In accordance with Queensland State Legislation, the Caloundra Chamber of Commerce & Industry Inc has developed an Emergency Evacuation plan which sets out the procedures to be followed in the event of a major fire or other serious emergency. In the event of a call for evacuation, stallholders are advised that the following procedures will apply:
– A decision to evacuate the market precinct (or part thereof) will be made by the Emergency Response Group which will consist of the Market Manager (Chief Warden) and Team Members (Wardens).
– In the event of the absence of any of these persons, the person acting in the position will have full authority.

ACTION TO BE TAKEN WHEN AN EVACUATION IS ORDERED
    – Follow the instructions of the Wardens listed above.
– Immediately remove any umbrellas or other temporary structures that may impede access of emergency vehicles.
– Move away from the event as directed by the evacuation map in this document
– Assist and direct members of the public and other persons to proceed away from the event in accordance with the evacuation plan map.
– Proceed to the nominated assembly area and await further instructions from the Wardens.
– Encourage members of the public to remain in the assembly areas until all clear is given.
– Should you witness a potentially life-threatening event, immediately contact Emergency Services via 000. Once Emergency Services have been notified, contact the Market Manager or Team member on the following number: 0488 222 805.
– Take whatever steps you can to assist in the emergency without putting your own life at risk.

EXCLUSION OF LIABILITY
To the maximum extent permitted by law, we exclude and are released from any liability to you and your employees, agents, contractors and invitees, whether in contract, tort, statute or any other way, for any personal or financial injury, damage or loss of any kind whatsoever (including, without limitation, any liability for direct, indirect, special or consequential loss or damage), sustained by you, your employees, agents, contractors, invitees and/or any other person, or for any costs, charges or expenses incurred by you, arising from or in connection with your occupancy of the Stall, unless caused by (and only to the extent of) our willful misconduct, negligence or breach of a statutory duty or warranty.

INDEMNITY
You are liable for and indemnify us and our directors and officers from and against any claim or action (whether in contract, tort, statute or otherwise,  including for negligence), liability, loss, damage, costs (including but not limited to, legal costs on a full indemnity basis), charges and expenses arising from or in connection with your occupancy of the Stall, including, without limitation, loss of or damage to property, or personal injury or death of any person. This indemnity is independent from your other obligations under these Terms and Conditions and will continue while you are a Stallholder and after you have ceased to be a Stallholder. We may enforce this indemnity before incurring expense
